NEW YORK (Reuters) ? Stocks ended mostly higher in a volatile session on Thursday as better-than-expected economic data and German approval of a stronger euro-zone crisis fund soothed two of the worst fears hanging over the market.

Based on the latest available data, the Dow Jones industrial average (.DJI) was up 143.08 points, or 1.30 percent, to end unofficially at 11,153.98. The Standard & Poor's 500 Index (.SPX) was up 9.34 points, or 0.81 percent, at 1,160.40. But the Nasdaq Composite Index (.IXIC) was down 10.82 points, or 0.43 percent, to close unofficially at 2,480.76.

(AP) ? Authorities say they are closing in on a murder suspect who has been the subject of the largest local manhunt in decades ? even as they reported he shot at a group of sheriff's deputies Thursday.

The Alameda County deputies searching in the redwood forest where the man has been at large for more than a month weren't hit and fired about 10 shots in response, Mendocino County Sheriff Tom Allman said at a Thursday night news conference.

Aaron Bassler, 35, is suspected of killing a city councilman on Aug. 27 and one other person several weeks before. Bassler is thought to be hiding out in the redwoods outside of Fort Bragg and is believed to have broken into several cabins to steal food and at least two other weapons.

Allman did not know how many shots Bassler is suspected of firing, or whether he had been wounded in the exchange. More law enforcement officers were being flown into the area to join the 40 officers involved in the search, he said.

"We believe we really and truly encircled him in a way that tomorrow may bring resolution ... but I have said that for 34 days," Allman said.

The search was scheduled to continue around the clock, with air searches, fog permitting, in the daytime. Investigators believe Bassler is hiding in the forest and surviving without help from anyone.

"We have no reason to believe people are supplying him with food, logistics, information. There is $30,000 reward," Allman said.

Officials are asking residents and others to stay out of the forest until Bassler is captured.

Fort Bragg City Councilman Jere Melo, who also worked as a security contractor, and a co-worker at a private timber company confronted Bassler while investigating reports of an illegal marijuana farm outside of town.

It was unknown whether the gunman was stalking the officers during Thursday's exchange of gunfire but he was using a high powered assault rifle like the one believed to have killed Melo, the sheriff told reporters. "He clearly was shooting at them with a rifle." he said.

Police said Bassler was cultivating some 400 poppy plants and was holed up in a makeshift bunker when he fired on the 69-year-old Melo and the co-worker, who escaped and called for help.

Bassler is also being sought in the fatal shooting of Matthew Coleman of the Mendocino County Land Trust. The former Fish and Game Department employee was found dead next to his car on Aug. 11 up the coast from Fort Bragg.

Both men were highly respected for their love of the land and their community work. The 7,000 residents of Fort Bragg have been on edge while the manhunt by dozens of local and federal agents has enveloped their coastal fishing and lumber community.

James Bassler said he believes his son suffers from schizophrenia and for years has talked about aliens and spaceships, while crafting Chinese military stars and drawings of weapons systems. His son was arrested in 2009 after he was accused of flinging some of those red stars over the fence of the Chinese consulate in San Francisco, but was released after authorities determined he was not an immediate threat to himself or others.

Aaron Bassler was arrested again on DUI charges in February after he allegedly rammed his truck into a school tennis court. He lost his license, and shortly afterward, lost his place to live.

"He lost his truck, then he lost his place to live; all his links to the real world," his father said in an interview last week.

Earlier this week, authorities released a photo of Bassler vandalizing a vacation cabin while holding a high-caliber rifle. On Wednesday, they confirmed his fingerprints linked him to another burglary at a cabin.

James Bassler said he had tried for years to get county authorities to have his son put into a mental health program, but that his letters and calls had gone unanswered due to privacy laws that protect his son.

LOS ANGELES (TheWrap.com) ? You love him as British cop "Luther," you loved him as the thinking man's drug kingpin Stringer Bell on "The Wire," and Idris Elba hopes one day you'll love him as the post-Daniel Craig James Bond.

Asked in an interview with National Public Radio if he'd be interested in the role, the Emmy-nominated "Luther" star said he would be -- but only if he's not known as the "black Bond."

"I'd definitely consider it," Elba said. "I just don't want to be the black James Bond. Sean Connery wasn't the Scottish James Bond, and Daniel Craig wasn't the blue-eyed James Bond, so if I played him, I don't want to be called the black James Bond."

NPR interviewer Linda Wertheimer then tried to elicit a more committed response from Elba, asking if he'd jump into a cab if Sony called and asked him to come to a meeting about a potential 007 movie.

"I'd not only get in the cab, but I'd take the taxi driver out of the car, hostage," he said. "The taxi, jump out while it was moving, jump onto a pedal bike that was just past the door as I got on it, and then get onto a plane -- on the wing -- land on top of Sony Studios, slide through the air conditioning, and land in the office."

And that's why he should be the next James Bond.

Further, there are so many schemes that, while they appear legitimate, are pure scams. If you take your time, do a lot of research prior to signing on to something and don?t get taken in by the hype, you can make wise decisions and avoid losing your money to fraud.

Many e-commerce sites are trustworthy and have taken the necessary safety measures to shield you, but it still never hurts to proceed cautiously. If you decide to make an online purchase consider these simple steps:

1. Make all purchases with one credit card, preferably with a low credit limit. Avoid using an ATM or debit card because that?s money taken directly from your account.

2. Be wary of unsolicited offers by sellers. If it looks too good to be true, it probably is. The Internet National Fraud Information Center Watch reported that email scams was up 22% in 2006.

While the offer may seem legitimate, spammers and phishers like to use this tactic to side-step reputable sites that provide consumer protection for online purchases. They will send you to a site that looks just like the real thing.

You put in your information and you are a victim in about 3 seconds. If you get an email asking you to confirm our Paypal, eBay or bank account information, whatever you do, DON?T CLICK ON THE LINK IN THE EMAIL.

Go to the site directly by typing in the site name, and see if there is anything related to the email. In 99.9% of the time, it is not. It?s a fraud waiting to steal your personal information. You can also tell that the email is fake because it won?t have your name in it.

3. Use only reputable e-commerce websites that list a street address and telephone number in case you need to contact them directly. If you look all over the website, and you can?t find bona fide contact information, move cautiously.

You wouldn?t go into a store with no sign or street address, would you? Well, this is no different. If you can?t find a number that connects to a human being and an address, keep on looking.

4. Read the website?s privacy policy. Some websites may reserve the right to sell/give your information to a third party. Check the document to see if they allow an opportunity to "opt-out" of receiving special offers from third-party vendors or for permission to share your personal information.

If you want your name sold to a ton of people you don?t know, then don?t take this extra precaution. If they do it, and there isn?t a place to opt-out, move on. It?s not worth the amount of spam you will receive.

5. In the lower right-hand corner of your browser should be a small lock icon which indicates that the site is secure. Also, do not provide your personal information if the website address doesn?t start with "https" on that checkout page.

This isn?t on the whole site, but wherever you are putting your credit card must have these two things in place. If you can?t find it or you see an unlocked lock icon, don?t put your personal information and credit card information in there.

While the company may be completely legitimate, it is not secure. On the web, you can?t take that chance. Find an alternative way to shop with them if you really want to.

6. Choose only verified sellers. Check to see if the vendor is a verified member of a reputable third party such as the Better Business Bureau, VeriSign, or Guardian eCommerce.

These third-party sites help to ensure online consumers will be protected when shopping or conducting e-commerce transactions.

Shopping on the Internet can be both convenient and fun, if you take the proper precautions. Simply know the rules of the road and what you should be looking for on websites, and you should have no trouble. If you do, contact the Better Business Bureau.

Baseball Expert Tony DeMarco has been covering the big leagues since 1987, and been casting Hall of Fame ballots for the last 12 years. He answers questions weekly here:

Q: Do the Yankees have enough pitching to win the World Series? I'm concerned they will not be able to out-slug the teams from the National League, especially the Phillies.
? Matthew Bowler, New York

A: I have not been a strong believer in the Yankees rotation all season. Back in spring training, I thought they were an iffy playoffs proposition, primarily because of a lack of rotation strength behind CC Sabathia. But they're better than I thought, and finished with the AL's best record and No. 1 playoff seed.

It would be simplifying things to say that the Yankees' winning formula simply involves a highly potent offense building leads for an excellent bullpen to protect. After all, they are sixth in the AL in rotation ERA, and did get a 16-4-3.70 season from Ivan Nova, and a 12-8-3.62 year from Freddy Garcia ? besides more Sabathia excellence, of course.

That said, I don't like how the Yankees' rotation matches up with the Phillies', or even the Brewers'. And long before either of those two possibilities might occur, the Yankees are looking at a division-series matchup with a team that beat them 4-3 in their regular-season series, the Detroit Tigers.

Facing Justin Verlander twice in a short series will be a tall order. The Yankees also have hit left-handed pitching better than right-handed pitching this season, and the Tigers will feature an all right-handed playoff rotation, including a very-hot Doug Fister.

That contrasts the Texas Rangers, who will have at least two ? and possibly three lefties ? in their playoff rotation. Not coincidentally, the Yankees pounded on the Rangers in the regular-season, holding a 7-2 series edge with a +27 run differential.

The Rangers' home ballpark also is much more homer-friendly than Detroit's Comerica Park, and the Yankees rely on the long ball more than anybody.

The AL series matchups are going to be very important. Remember, if the Red Sox do survive and win the wild card, they beat the Yankees 12 of 18 times this season.

But more so than at any other time, the playoffs are about starting pitching. The most-dominant starting pitching usually translates to the World Series winner. And that's why it will be very hard for me to pick the Yankees to come through the AL playoffs, let alone win another World Series.

Q: Verlander is getting a lot of attention for the AL MVP Award, but how about the season his teammate, Miguel Cabrera, has put together?
? Brian, Ann Arbor, Mich.

A: I'm not a big proponent of pitchers' winning MVP awards, but there are legitimate exceptions to every rule. The last time the Tigers won it all, a closer ? Willie Hernandez ? was the AL Cy Young and MVP winner; and Hall of Fame closer Dennis Eckersley won both awards in 1992.

But for me, in both of those cases, there wasn't an outstanding position player MVP candidate, and that cleared the way for Hernandez and Eckersley. And that's not the case this season, when Cabrera, Jacoby Ellsbury and Jose Bautista have had MVP-type seasons.

Hernandez got 16 of 28 first-place votes in 1984, when amazingly, Royals closer Dan Quisenberry finished third overall in the MVP balloting. That left Minnesota's Kent Hrbek (.311-27-107) as the highest finisher among position players, while the Tigers' Kirk Gibson finished sixth and Alan Trammell ninth.

Eck also won easily for the 1992 Oakland A's, getting 15 of the 28 first-place votes ? including mine ? and outdistancing Kirby Puckett (.329, 19 HRs, 110 RBIs, 17 SB, Gold Glove), while three key hitters from the World Series-champion Blue Jays ? Joe Carter, Roberto Alomar and Dave Winfield ? totaled nine first-place votes between them.

(AP) ? Amanda Knox, the American student convicted of killing her British roommate, is a "she-devil" who deliberately accused an innocent man to cover her own crime, a lawyer for the man unjustly implicated in the case said Monday.

Knox was convicted of sexually assaulting and murdering Meredith Kercher while they were studying in Perugia in 2007, and sentenced to 26 years. She denies wrongdoing and has appealed the lower court's verdict, issued in 2009.

Early in the probe, Knox accused Diya "Patrick" Lumumba of being the murderer. As a result of that claim, Lumumba was jailed for about two weeks ? and then cleared and freed.

On Monday, Lumumba's attorney addressed the court hearing Knox's appeal. Lumumba is a civil plaintiff in the case, and in Italy civil portions of cases are heard at the same time as the criminal matter.

"Who is Amanda Knox? Is she the mild-looking, fresh-faced person you see here, or the one devoted to lust, drugs and alcohol that emerges from the court documents?" Lumumba's attorney, Carlo Pacelli, asked the appeals court.

Pacelli maintained that a double soul co-exists in the 24-year-old American.

"Both a (saint) and a demonic, satanic, diabolical she-devil, which leads her toward borderline behavior. This was the Amanda of Nov. 1, 2007," the night of the murder.

He insists that, at the time of the crime, "she was an explosive mix of drugs, sex and alcohol."

Kercher was stabbed to death in the apartment she shared with Knox. The American student at one point told investigators she was home during the killing and had to cover her ears to drown out Kercher's screams while Lumumba was murdering her, according to court documents.

Knox maintains police pressure led her to accuse Lumumba, a Congolese national who owned a bar in Perugia where the American occasionally worked.

While Lumumba is a civil plaintiff in the case, he is also seeking damages from Knox in a separate procedure because her claim led him to be unjustly detained.

Knox's co-defendant in the appeals trial is her former boyfriend Raffaele Sollecito. He was convicted of the same charges and sentenced to 25 years. He, too, denies wrongdoing.

A verdict in their appeals case is expected by next week. Knox and Sollecito hope to be freed after four years in jail; prosecutors have asked the court to increase the sentences of both to life in prison, Italy's stiffest sentence.

Also convicted in separate proceedings was Rudy Hermann Guede from Ivory Coast. Italy's highest criminal court has upheld Guede's conviction and his 16-year prison sentence. Guede denies wrongdoing.
